Another Increase In OSHA Penalties Has Occurred

It only took about six months for OSHA penalties to see yet another increase. On August 1 of last year, a huge bump in OSHA penalties occurred, surrounding violations of safety and health regulations via the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. Since then, another increase arrived at the top of 2017 on January 13, well over 1%. Here are the adjusted maximum penalties for violations:

Other-than-Serious: $12,675

Serious: $12,675

Repeat : $126,749

Willful: $126,749

For further clarification, a series of dates were offered to better understand which penalties apply for violations: 

  • For OSHA violations that happened on or before 11/2/15, with penalties assessed on or before 8/1/16, the pre-8/1/16 penalty level applies.
  • For OSHA violations that happened on or before 11/2/15, with penalties assessed after 8/1/16, the pre-8/1/16 penalty level applies.
  • For OSHA violations that happened after 11/2/15, with penalties assessed after 8/1/16 but on or before 1/13/17, the 8/1/16 penalty level applies.
  • For OSHA violations that happened after 11/2/15, with penalties assessed after 1/13/17, the 1/13/17 penalty level applies.
